New fines as from 1 February 2009 to combat the main causes of road accidents

The implementation of higher maximum fines for traffic offences aims at improving road safety in Germany. They are primarily targeted at the main causes of road accidents, such as

  • inappropriate speed
  • dangerous overtaking
  • right-of-way violations
  • ignoring red lights
  • failure to keep a safe distance to the vehicle in front.
The changes to the schedule of fines and penalties serve the purpose of increasing road safety. There is no intention of increasing all fines. The situation will remain unchanged as regards on-the-spot fines and parking offences. The duration of potential driving bans will remain unchanged, too. Speeders and tailgaters in particular as well as especially reckless drivers who deliberately endanger other road users will have to accept considerably higher fines.

According to provisional results of the Federal Statistical Office, 4,467 persons were killed in road traffic accidents in Germany in 2008. The cause of almost all accidents (95 per cent) is human error. Up to now, the fines in Germany were rather low in comparison with other European countries. Countries such as the Netherlands, Great Britain and Sweden rank top in road safety performance, with the fines for dangerous driving offences being considerably higher in these countries. Therefore, raising the maximum fines was appropriate and necessary.

The new maximum fines were introduced by an amendment to the Road Traffic Act. The Schedule of Penalties Regulations entered into force on 1 February 2009.
